Can I still get my Social Security Disability Benefits If I'm Overseas?

Receiving Disability Benefits While Living Overseas
The Social Security Administration (SSA) allows certain individuals to receive disability benefits even if youre living abroad. It can be difficult to understand many of the rules and exceptions that SSA has in place. Normally, individuals can receive Social Security Disability Insurance (SSDI) and Supplemental Security Income (SSI) when living in or traveling to another country. This means that if you are only "traveling" you can still retain your disability benefits. Now if you leave the US, you may lose your SSI benefits if you leave the US for a period of 30 days or longer. Keep in mind that this only applies to SSI recipients and likely does not apply to SSDI recipients.

If you're thinking about hiring a social security disability attorney to help with your Social Security case, you should understand the benefits of having a lawyer on your side. One main setback for many people is that fees attorneys charge. The easiest way to put it is that attorneys only get paid if they win your case. If they dont win, you do not owe them a fee. Social security disability attorneys charge a fee regulated by federal law, which is usually the lesser of 25% of your disability back pay or $6,000, whichever is less. No money is required up-front, and you're only charged a fee if you win your case.

Applicants for Social Security disability (or SSI disability) are very unlikely to find an attorney to represent them for free. But the good news is that you will not have to pay an attorney up front to represent you in your claim for social security disability benefits. This is because attorneys who help disability claimants work on a contingency basis. This means that they only get paid if they win your case. If they do not get you approved for disability benefits, the attorney takes nothing.

Your medical records and a medical narrative from your doctor can help prove that your joint functioning is abnormal.

If your arthritis affects your hip, ankle or knees and its difficult to walk, that will also help your chances of being successful in your claim. However the Social Security Administration (SSA) has rules in order to do so.

According to SSA's Program Operations Manual System (POMS), one must be considered a "proper applicant". A proper applicant is someone who can sign off on an application for benefits on behalf of the disabled claimant. Usually the claimant is considered the proper applicant in most cases as the claimant is the one applying for disability. However, if the claimant is unable to file his or her own application, another proper applicant may be the claimant's spouse, a court-appointed representative, or a relative responsible for the claimant's care.

In addition, Social Security recognizes that medical conditions are less likely to resolve themselves quickly after you reach age 65.

Keep in mind that you do have to be under full retirement age to collect Social Security disability.
